Ekiti Monarch’s Installation Affirms By Appeal Court

The Court of Appeal sitting in Ado Ekiti yesterday dismissed an appeal filed by the Afayagbekun and Arobiogbon ruling houses against the installation of the monarch of the community, Oba Samuel Fadahunsi, as the court affirmed the monarch as the Onijan of Ijan Ekiti in Gbonyin Local Government Area.

sentence16-300x300The three-man appeal panel headed by Justice Moshood Oredola, dismissed the appeal and described the selection and installation of Oba Fadahunsi as legitimate and in tandem with the customs and tradition of the town. The judge also awarded a N50, 000.00 cost against the appellants.

The lower court headed by the Chief Judge of Ekiti State, Justice Ayodeji Daramola, had on November 28, 2008, upheld the installation of the monarch and affirmed that he should continue to enjoy all the paraphernalia and privileges of that office.

The Appeal Court ruled that all the oral and documentary evidence presented by the respondent, Oba Fadahunsi, were credible and had probative value, contrary to the appellants’ claims.

Based on the evidence, the judge declared the ruling house that presented the monarch- Otutubosun ruling house as duly recognized by the state Chieftaincy Law as part of the ruling houses, saying the enthronement of Oba Fadahunsi as candidate from that dynasty did not contravene any law.

Oba Fadahunsi ascended the throne on September 18, 2001, having been screened and approved by all the kingmakers after the death of Oba Adeyemo Obarinde in February 2000.

He was subsequently approved by the then Otunba Niyi Adebayo-led administration on September 24, 2001, after which he was presented the staff of office on April 29, 2003.

The court had earlier vacated the interlocutory order got by the plaintiffs restraining the government from recognizing him as the monarch of the community.

Responding to the judgement, Oba Fadahunsi charged the appellants to embrace peace and join hands with him to bring development to the ancient community.
